Letter of demand legal

A letter of demand is simply a letter which sets out the details of a debt which is owed by one person to another (or one company to another). A typcial letter or demand is based on a set of invoices which have not been paid. Normally the letter will begin by outline the amount owing, the documentation on which the debt is based, and any acceptable payment methods. All importantly, the letter of demand contains a demand, which is usually that the person who owes the money pay or else face the consequences of not paying which is usually legal action.

The legal aspects of a letter of demand are that in some juristdictions, it is required that the letter give certain notice requirements that if the creditor does not receive the appropriate funds in a certain time frame legal action will commence. If this notice is not given, it can make the litigation which later ensues involid because the defendant can point to the fact that notice has not been given correctly of the debt and they can say that they would have debt with the matter appropriately if they had known about this.
