What are the major considerations in a commercial debt recovery?

The first thing to examine is what the capability of the debtor is to be able to pay the debt. This must be paramount. You should try to identify the debtor’s employment situation and income from investments or the operation of a business. You then try to identify what assets they have and what they could possible sell in order to pay the debt off. You may wish to do property searches on their assets or searches of ASIC registers in order to identify the official records of their assets or of their company directorships, shareholdings and other sources of income. The reason that this is so important is that without this vital information, an entire debt recovery process coud be pursued including bankrutpcy proceedings only to discover that the debtor has divested themselves of all assets or was so hopelessly insolvent that they never had any hope of paying the debt off at all. If you do some research like this initially, you will at least have some protection against this risk.

Collect the basic details of the debtor like their name, address, contact details, the documentation which you can use to prove the basis of the debt and the previous contact you have had with them so that you know exactly what is going on in terms of their relationship with you.
