What do I need to know about an Australian Debt Collectors?
This ultimately depends on what you are looking for. There are some key considerations if you are looking for an appropriate Australian debt collector to help you recover your debt. Australia is broken up into several different legal jurisdictions which have various legal systems which debt collection processes are based around. For instance, in New South Wales, the New South Wales Local Court is the first port of call and it can hear cases with up to $10,000.00 of debt in issue. However, in Queensland the first port of call may be the Queensland Magistrates Court. In Victoria, you could choose between the county court and the small claims tribunal as all of these are options. The other jusridictions of South Australia, Western Australia, the Northern Territory and the Australian Capital Territory also have their own independent jurisdictions which have individual quirks and idiosyncracies. Although there are similarities in relation to all of these geographical areas and the debt collection process which they use, it usually requires a person who is at least familiar if not an expert in the local laws so that they can guide you on the correct path to a successful debt recovery process.
There are also a number of different types of matters which can be dealt with at a federal level. Corporations applications can be made in the Federal Court for the winding up of a company that has failed to comply with a statutory demand. This is part of the insolvency related debt collection process. When a company fails to comply with a statutory demand, it is presumed to be insolvent and the court must wind it up if it is an insolvent company. In some cases it is possible to institute a debt collection process through a debt collector in any State of Australia as long as they have access to a lawyer that can handle matters of federal jurisdiction.
