The bulding and construction industry has endemic problems relating to the non-payment of money. It seems that no matter what the project involved, there is always some sort of dispute erupting becuase of a disagreement about the contract, what the builders were supposed to provide, what the employer was supposed to pay, what the subcontractors were supposed to be paid, what the suppliers actually delivered to a building site and what work was actually done by the labourers or the builders.
There are a few different processes for resolving disputes in the building and construction industry which are used to resolve disputes about the payment of money. For example, in New South Wales there is the adjudication process which is used. Some disputes relation in relation to payment under the Building and Contruction Industry Security of Payment Act NSW are heard before a special tribunal set up to deal with these matters before they go to the building and construction list in the Supreme Court of New South Wales (if the matter involves enough money).
However, it is also possible that a simple contactual dispute can begin with a debt collection process and if it is a relatively small matter go through the debt collection process of the local or district court. It will stay at the local court level if it is a matter worth less than $10,000.00 and it must be reffered to the Supreme Court if the matter involves more than $750,000.00 However, the natural process of the initial stages of debt collection is still the same as in any other system. There is making a file, a phone call, a payment reminder, a letter of demand and then legal action. This is the basic process in all debt recovery matters. Then there are the various legal processes which may involve insolvency if the debtor is unable to pay their debts as and when they fall due and payable.
